A Personal Injury claim is where you have suffered an injury or illness caused by the acts of another person, which is referred to as “negligence”. If you have suffered such an accident and sustained an injury, then you may be able to claim damages. How Long Do I Have To Make a Claim

You only have 3 years from the date of the accident or from the age of 18 if in the case of an accident involving a child to make a claim – see Child Claims section. In some circumstances the 3 years may run from when you became aware of the injury and/or the identity of the Defendant if unknown at the time of the accident.

There are also shorter time limits for some types of accident such as where an injury has occurred on a boat, on an aircraft or when abroad and so it is very important to contact us as soon as possible after any accident.

Losses Arising from a Personal Injury Claim

Suffering an injury as a result of an accident which was not your fault not only causes pain and suffering but can also place you under financial difficulty if you cannot return to your usual lifestyle for a period of time. In addition to suffering injury, you may also suffer additional losses such as:-

  • Loss of Earnings
  • Care and assistance from a friend or family member who has had to take time off work to support and care for you as a result of the accident.
  • Private treatment costs (physiotherapy/counselling/surgery/nursing care etc)
  • Travel Expenses/Bus and Taxi Fares
  • Prescriptions Charges
  • Loss of DIY/Gardening/Memberships
  • Damage to Clothing
  • Changes to pensions
  • Benefits
  • Alterations to your home and vehicles in more serious injuries

It is important that you keep a record and evidence (where possible) of any losses suffered as a result of your accident. For example, wage slips, taxi/bus fares, receipts for prescription charges or private treatment costs.

The Defendant is less likely to present a challenge to a head of loss which is supported by evidence.
