Each week we are taking questions from our clients and contacts.  This week Mr. Harwood from Barnsley asks: “I have been asked to attend a voluntary interview. Do I have to go and how much does it cost for a solicitor to come with me?”

 

Vanessa Saxton – The Head of our Criminal Department replies as follows:

 

“A voluntary interview is an interview with the police that is arranged at your convenience.  If you do not attend, the likelihood is that you may be circulated as wanted and then arrested to enable the officers to interview you.  If you are arrested this then gives the police the power to put you on bail with conditions.

The police cannot do this if you attend as a volunteer, subject to there being no arrest following your interview.  It is for this reason we would always recommend that you obtain legal advice if you are invited to attend a voluntary interview with the police.

When the police wish to speak to you the replies you make may influence your case and affect any future outcome.  You may think that the matter is only minor or that you haven’t done anything wrong. However, we would always recommend that you attend with a legal representative.

You will not be charged for having a solicitor attend the police station with you for a voluntary interview. This is covered by Legal Aid, which is available to everyone when detained at the police station or invited for an interview by the police.

This applies regardless of your financial circumstances. If you are unsure whether you qualify for legal aid in other parts of your case, we can provide advice on that as well.

 

When are we available?

 

We are available 24 hours a day, 365 days a year. If you have been contacted by the police to attend an interview, or if you are arrested, contact our team as soon as possible.

It’s important to notify us as early as possible, so we can arrange for a solicitor to attend with you. You can contact us directly or ask for us at the police station if you are already there.

Once you have arranged a date and time for your voluntary interview, all you need to do is get in touch with us and let us know the details.

Before your interview, the police will provide disclosure, allowing us to speak privately and offer you advice.”
