MIB Claims (Claims against an uninsured or an untraced driver)

The Motor Insurers’ Bureau (“MIB”) was founded in the UK in 1946 as a private company limited by guarantee and is the mechanism in the UK through which compensation is provided for victims of accidents caused by uninsured and untraced drivers.

The Process

You may be eligible to make a claim for personal injury if you have been injured as a result of being hit by an un-traced or un-insured driver.

Before submitting an application to the MIB it is important that you have tried your best in an attempt to trace the third party vehicle (i.e make a report to the police, request nearby CCTV footage, try and locate any witnesses to the accident). The MIB will need to be aware of your efforts in trying to obtain the third party details so that they can be satisfied that attempts were made to obtain these details.

Nevertheless, the MIB will carry out their own investigations into your claim. An example of the claims process is set out below:-

  1. The MIB will attempt to trace the untraced driver and/or a relevant insurer to deal with the claim. The MIB may instruct tracing agents to do this
  2. The MIB will check if you reported the accident to the police and will contact them for a copy of any report and the result of their investigations, even if the police have decided to pursue it or not.
  3. The MIB will request a full set of your medical records. They will consider the medical history and look for any GP or hospital attendances after the incident.
  4. The MIB will arrange a medical appointment for you. Their usual medical organisation is Doctors Chambers. The MIB will forward a full set of your medical records to Doctors Chambers for their review prior to your consultation with the expert. If applicable, the MIB can also offer private treatment and instruct case managers.
  5. The MIB will instruct an enquiry agent, usually from Exam Works, to go to your home address and take a witness statement from you. The MIB can also get the enquiry agent to take a statement from any witnesses to the accident or relevant parties.
  6. The MIB will ask for vehicle damage evidence in the form of engineering evidence from you and your insurer.
  7. The MIB will get locus reports (accident reports) if needed and any further expert reports they deem necessary.
  8. The MIB will assess your claim and confirm whether it is accepted.

The above case is an example of the process. Each claim is different and the actions needed will differ on a case-by-case basis.

How Long do I Have to Make a Claim?

You only have 3 years from the date of the accident to make a claim. If the case involves a child the 3 years will begin after the date of their 18th birthday. In some circumstances the 3 years may run from when you became aware of the injury.
